In most New Jersey municipalities, building a new deck or replacing an existing one requires a building permit. This includes footings that meet frost-depth requirements (typically 36 inches in NJ), proper ledger board attachment to the house, and railing height compliance (36 inches minimum, 42 inches for elevated decks).
